Privacy Policy

This Privacy Policy (the “Privacy Policy”) is intended to inform you about our policies and practices concerning the collection, use, and disclosure of information we receive when you access or use the website (the “Site”), along with any services, software, content, and all other products or services (collectively, the “Services”) that are owned, operated, or provided—directly or indirectly—by Palm Grove Social (together with its affiliates and subsidiaries, “Palm Grove Social,” “PGS,” “we,” “our,” or “us”). At Palm Grove Social, we consider user privacy to be of utmost importance. We are committed to using Personal Information (as defined below) solely in the ways described in this Privacy Policy.
This Privacy Policy is incorporated by reference into our Terms of Service. By using the Services, you represent and warrant that you have read, understood, and agreed to both this Privacy Policy and our Terms of Service, that you are a resident of the United States, and that you are at least 18 years of age. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, PLEASE DO NOT ACCESS, INSTALL, OR USE THE SERVICES.

1. What We Mean by Personal Information

For the purposes of this Privacy Policy, “Personal Information” refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

2. Information We Collect – Information You Provide To Us

When you use the Services or otherwise communicate with us, we collect information that you provide directly. This may occur in various situations, including the following: (i) when you visit the Site; (ii) when you register for the Services, create an account or profile, or accept the creation of an account or profile on your behalf (referred to as an “Account”; please note that account creation is not currently available on the Site but may be introduced in the future; in such a case, you will be informed); (iii) when you access the Services through social networking sites or third-party services; (iv) when you subscribe to newsletters; (v) when you purchase a product or service on the Site; (vi) when you invite others to join the Services, share the Services via social networks, or perform similar actions; (vii) when you request technical support; (viii) when you use our online Services in any way that requires Personal Information; or (ix) when you contact us through the Site or by any other communication method.
You are not required to provide the information we request; however, choosing not to provide it may limit your ability to access or use certain parts of the Services.

The information you provide to us may include, but is not limited to, the following types of data, which may constitute Personal Information either on their own or when combined with other data:
(i) Information provided during a transaction or purchase, such as your name, email address, and any other details you choose to submit;
(ii) Information sent via email using the contact information published on the Site, including your name, email address, message content, and any additional details you provide;
(iii) Information submitted to subscribe to newsletters or updates, such as your email address or any other optional data you provide. You can unsubscribe at any time by following the instructions provided in those emails or by contacting us directly;
(iv) If you are a customer, supplier, or business contact, we may collect limited Personal Information during the course of our interactions. This may include your name, company, job title, email address, phone number, mailing address, order details, and, where appropriate, credit registrations or credit limits;
(v) Transactional data and limited payment-related information that does not include PCI-sensitive details; and
(vi) Any additional information you may choose to share with us, such as Personal Information submitted in connection with recruitment or job applications.
In addition, we may retain a record of any correspondence if you contact us.
If another user refers you to our Services by submitting your email address, we may use that email address to send you a message. However, we will use your email address solely to deliver that message unless you independently choose to share more information with us.

2.1 Automatically Collected Information

Much of the data we collect through the Site and the Services is technical in nature; it is gathered and processed automatically through application programming interfaces (APIs), software development kits (SDKs), cookies, and similar software-based technologies. This data, whether used alone or combined with other information, may constitute Personal Information. Automatically collected data may include, without limitation:
(i) Device data – such as device advertising identifiers, other unique hardware identifiers, and precise geolocation data;
(ii) Usage data – such as search queries and pages you view;
(iii) Network and internet information – such as URLs visited, Internet Protocol (IP) addresses, bounce rates, indications of spoofing, active TCP/IP ports, session counts, clickstream data, approximate location, and information about network or Wi-Fi access points;
(iv) Cookie-based tracking data – such as information collected through cookies when you use the Site. For more details, please refer to the section titled “How We Use Cookies and Other Technologies.”
The Site uses analytics tools that operate through cookies. These tools may collect and store data such as the time of your visit, the specific pages you viewed, the time spent on each page, your IP address, and the type of operating system used on the device you used to access the Site.
When you visit or log in to our Site, cookies and similar technologies may be used by third-party vendors or future online data partners to associate your activity on our Site with other personal information they already hold about you. This may include, for example, information tied to your email address or home address. Based on such associations, we or service providers acting on our behalf may use this information to send marketing communications or other messages to those addresses.
You may choose to opt out of receiving such targeted advertising once these services are in place.

2.2 Information You Share on Third Party Websites or through Social Media Services

The Services may contain links to third-party websites and social media services that allow you to post comments, stories, reviews, or other types of content. When you use these external websites or services, they may collect or share information about you independently from us.
We recommend that you carefully review the privacy policies and settings of any third-party websites or social media services you interact with. This will help you understand what information may be collected, how it may be used, and with whom it may be shared by those third parties.

2.3 How We Use Cookies and Other Technologies

Certain features of the Site and the Services require the use of cookies, which are small text files stored on your device’s hard drive. We use cookies to analyze which pages are accessed and which features are used most frequently; this helps us improve the Site continuously so that it better serves the needs of our visitors.
We use so-called required cookies that allow you to navigate the Site and use its core features, such as accessing secure areas or interacting with parts of the Services. If you have chosen to identify yourself to us, we may use cookies that contain encrypted information to uniquely recognize you.
Because required cookies are essential for the operation of the Site, there is no option to disable or opt out of these cookies.
In addition, we and our service providers may use other technologies in connection with the Services and HTML-formatted email messages. These technologies can be used to track user behavior, evaluate the performance of future marketing campaigns, and compile aggregated statistics about Site usage and response rates.

3. Use of Collected Information

We use the information you provide to us for the following purposes:
(i) to pursue our legitimate interest in delivering the Services, which includes collecting and processing payment for paid features;
(ii) to manage your use of the Services and any Accounts you may maintain with us;
(iii) to personalize and improve your experience;
(iv) to send you Service-related announcements or to inform you about new features and releases;
(v) to provide you with additional information and offers from us or selected third parties that we believe may be relevant or of interest to you, including newsletters, marketing, or promotional materials;
(vi) to act on behalf of or under the direction of third parties such as payment processors, service providers, or advertising partners;
(vii) to enforce our Terms of Service;
(viii) to address or resolve disputes either between users or between users and us;
(ix) to comply with legal obligations or legal processes including, but not limited to, subpoenas, court orders, or other compulsory disclosures;
(x) to protect our rights, property, and safety, as well as the rights, property, and safety of our users, the Services, or the general public;
(xi) to contact you in order to gather feedback about the Site and the Services.

In addition to the uses described above, we also use information collected automatically for the following purposes:
(i) to support our legitimate interest in monitoring, analyzing, and improving the use and technical administration of the Site and the Services;
(ii) to enhance the functionality and overall quality of the Site and Services;
(iii) to develop insights into user behavior, interests, and preferences in connection with the Services;
(iv) to confirm that users meet the necessary criteria to process their requests.
We, and where applicable our advertising partners, may also use demographic and location data, along with information collected from your device such as your IP address, device model and identifier, MAC address, operating system, app usage data, device time zone, region, language settings, and click ID. This helps ensure that any advertising, if and when shown, is relevant and appropriately tailored to your profile.

4. Third Parties We Share Personal Information With

We may disclose the Personal Information you provide to us, or that we collect automatically through the Site and Services, to the following categories of third parties:
(i) Public authorities, such as law enforcement agencies or regulatory bodies, if we are required to do so by law or if the disclosure is necessary to protect our rights or the rights, property, or safety of others;
(ii) Our subsidiaries and affiliates, or any future owner, co-owner, or operator of the Site and/or Services. This also includes their professional advisors, in connection with events such as a corporate merger, acquisition, restructuring, the sale of substantially all of our assets or stock, bankruptcy, or other corporate reorganization, provided that such disclosure remains consistent with this Privacy Policy.

5. Links to Other Websites

We may make content or services from other websites available to you through links placed on the Site. Some of these links may be presented in a format that allows us to track whether you have followed them.
Please note that we do not control the content, privacy practices, or operations of any third party websites or services that are accessible through the Site or the Services. Your interactions with such third party services are governed by their respective privacy policies and terms of use. These websites or services may place their own cookies or other tracking technologies on your browser, collect data, or request Personal Information from you.
Since other websites may follow different rules regarding the collection, use, and disclosure of your Personal Information, we encourage you to review their privacy policies before using any third party services or providing them with your information.

6. Security

We recognize the importance of safeguarding your Personal Information and consider its privacy and security a priority. Palm Grove Social employs a range of industry-standard technologies and procedures designed to protect your Personal Information from unauthorized access, use, or disclosure. We also provide training to our employees to raise awareness about privacy and data security practices.
Despite our efforts, no method of transmission over the internet or method of electronic storage can be guaranteed to be fully secure. Therefore, while we strive to use commercially reasonable means to protect your Personal Information, we cannot ensure or warrant its absolute security. We cannot guarantee that unauthorized third parties will never find a way to circumvent our safeguards or misuse your information.

Palm Grove Social does not currently offer user accounts on the Site. However, if we collect any Personal Information from you, we retain it only as long as necessary for the purposes described in this Privacy Policy or as otherwise required by law.
You have the right to request access to, correction of, or deletion of your Personal Information. If you would like us to delete any Personal Information we may have collected about you, you may contact us using the contact details provided on the Site. Upon receiving such a request, we will limit our access to your information and delete the data we are able to remove within seven business days, unless we are required to retain it for legal or operational reasons.

8. California Residents

Under California Civil Code Section 1798.83, certain businesses are required to disclose whether they share customer Personal Information with third parties for the third parties’ direct marketing purposes. (i) The categories of Personal Information we have collected about you;

8.2 Requests to Delete

You have the right to request the deletion of any Personal Information that we have collected about you. Upon receiving a verifiable request from you, we will delete your Personal Information from our records unless we are legally required or otherwise permitted to retain it under applicable law.
You may submit a request to delete your Personal Information by contacting us via email using the contact information provided on the Site.
Please note that, in some cases, we may deny your deletion request if retaining the information is necessary for us to:
(i) Complete the transaction for which the Personal Information was collected, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship;
(ii) Detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity, or prosecute those responsible for such activity;

Alternatively, if the authorized agent has been granted power of attorney under California Probate Code sections 4000 through 4465, no additional verification from you may be required beyond confirmation of the agent’s legal authority.

8.4 Methods for Submitting Consumer Requests and Our Response to Requests

You may submit requests to access or delete Personal Information about you by contacting us via email.
After receiving your request, we may ask for additional information to verify your identity. This information will be used only for verification purposes and not for any other reason.
We will confirm receipt of your request within ten days. If we are able to verify your identity, we will respond within forty-five days. If more time is needed, up to a total of ninety days, we will notify you in writing and explain the reason for the delay.
To protect your privacy and the security of your Personal Information, we may request additional verification. In some cases, this may include a government-issued ID.
Our response will include only information collected during the twelve months prior to receiving your verifiable request. If we are unable to fulfill your request, we will explain the reason in our response.
We do not charge a fee for processing or responding to your verifiable request unless the request is excessive, repetitive or clearly unfounded. If a fee is necessary, we will explain the decision and provide a cost estimate before completing your request.

This includes providing our services, complying with legal obligations, addressing possible legal claims, and pursuing our legitimate business interests in accordance with applicable laws. After this period, we either delete or de-identify the Personal Information.
Please be aware that even if you request the deletion of your Personal Information, we may be legally required or otherwise permitted to retain certain information. Once those obligations no longer apply, we will delete the Personal Information in line with your request.
